Why land risk is the most underpriced variable in renewable project finance

Grid connection risk gets an engineering study. Permitting risk gets a regulatory timeline. Land risk, on far too many projects, gets a title search and an option agreement — and then surfaces again, expensively, well after financial close.

Land looks like the simplest constraint in a renewable project. Either you have rights to it or you don't. In practice, land risk is rarely binary — it is layered, and most of the layers underneath basic title are exactly the ones that do not get properly tested before a project reaches financial close, because they are harder to check and easier to assume away.

Title is necessary. It is not sufficient

A clean title search confirms legal ownership at a point in time. It does not confirm that the ownership is uncontested in practice, that the parcel's boundaries match what is recorded, that customary or informal use rights don't overlap the registered title, or that the specific rights needed for a renewable project — long-term lease or easement, construction access, and often a separate right-of-way for the grid connection corridor — have actually been secured rather than assumed to follow automatically from a purchase or lease option.

Legal & registry risk

Title accuracy, competing or historical claims, and whether the registered boundary matches the surveyed parcel used in the project layout.

Tenure & rights-bundle risk

Whether the specific rights required — lease term, construction access, and a distinct right-of-way for the grid corridor — are all actually secured, not just the base ownership or occupancy right.

Customary & informal-use risk

Overlapping use by communities or informal occupants that may not appear in a formal registry search but can materially delay or block construction access.

Cumulative & corridor risk

Whether the same land or corridor is also being pursued by a competing project, or whether aggregation across multiple adjacent parcels introduces a weak link that undermines the whole site.

Why this risk is systematically underpriced

Grid and permitting risk get modelled properly because they are visible early and their consequence — a stranded interconnection application, a rejected permit — is dramatic and immediate. Land risk tends to surface later and more quietly: a construction contractor discovers an access dispute once mobilised, or a right-of-way negotiation that was assumed to be routine turns out to require a renegotiation of terms with a landowner who now has leverage because construction has already started. By the time it surfaces, the cost of resolving it is far higher than the cost of finding it during screening — and the project timeline absorbs the delay whether or not it was modelled for.

There is also a structural reason developers under-invest in land diligence specifically: much of it requires local, on-the-ground verification — customary use patterns, informal occupancy, or a community's actual relationship to a parcel — that does not show up in any registry and cannot be checked remotely. It is genuinely harder to diligence than a grid capacity figure published by a utility, so it gets diligenced less thoroughly, not because it matters less.
